It is the intention of the Founding Committee to put in place a framework, for development by the EEVC Association Ltd., to guide the setting up of an ecologically sustainable and economically viable community (eco-village) at the property known as Etherion.

We expect that this framework of guidelines, policies and principles will be adjusted, modified and adapted to eventually form the basis for a system of governance for the community; and will include in its final form a method of transformation, to meet new parameters when and if they arise, that allows suitable modifications (as may be necessary) whilst holding clearly in sight the initial vision for this community.

In the process of evolving into a comprehensive doctrine of both 'hard' and 'soft' guidelines we hope that all members (both early and later) will add their views, beliefs, and wisdom, and gain from both the 'process' and the 'outcome'.

The following is a summation of material presented at meetings, and from sub-groups, over the last 20 months. It is suggested you link to this material to read it in the context of other discontinued idea threads.

2. Overview of General Framework & Legal Structure of the Community Association (EEVCA):

The property known as Etherion is currently owned by a private company and the structure of this company includes an issue of 180 Unit Trust Share Certificates.

Their stated value is $2,000.00 and they are available to be issued as security scrip to Full Members of the EEVCA (Etherion Eco -Village Community Association).

This group will be a Limited Liability Non- Profit Association registered within NSW holding general insurance cover for its Members, and also Public Liability cover for all guests whilst they are at the property, (see note below 'Guests to be signed in by a Member').

Full Members (Interim / Probationary Members are given this offer too) will have an option to take up an offer of receiving a parcel of land / allotment / domain [initially of one (1) hectare (2.5 acres)], which will be made available to them under an arrangement (a contract for Right of Use) whereby they will have exclusive use of the allotment, but will be required to continue to maintain it.

Maintenance will include the provision that the Member resides at the property for a fixed percentage of each year (some conditions apply) and meets such other requirements as the Association sets down at the Annual Common General Meetings (and / or Special General Meetings).

Use of the Domain will include the ability to gain Local Council approval to erect a residential dwelling house, and other buildings and structures as required that meet council specifications.

A Full Member is able to transfer use of this Domain to another person (via a Sale of their Right of Use), subject to that person being approved by, and joining, the EEVC Association, (specific provisions apply see below Member Selling via a Four Stage Process and Sale of Right of Land Use).

Etherion Vision Statement

Etherion is the name and way of our community. Etherion has characteristics of the heavenly, where our soul life, social experiences and ecology reflect the goodness of love, creation, simplicity and balance. We'll live on top of a mountain, in light and air, amongst forests and gorges, water holes and stars. We'll create freedom to live according to who we truly are in our hearts and freedom from those things that limit us. And with these, our community is designed. This is our dream…to create a place where we all live in our dreams.

Spirituality
Realising our selves and our relationships with each other and our earth lies at the heart of our intention. Balance and harmony will be created by the soulful living of each person. The love and energy created by our spiritual lives will bring about joy and harmony, humbleness, purity and giving. These values drive our choices and actions. Our souls growth is individual as well as communal as we share our life experiences. Meditations, yogic living, holistic living and ceremonies are all part of the spiritual practices offered for our growth. Commitment to learning about and experiencing our souls paths live at the core of our efforts. We believe in creation, possibilities and at times impossibilities, and work with our creator to achieve them.

Community
Our community has been created for all ages, children to elders. Love for each other through family and friendship is our achievement. We are self-governing therefore the communal life we aim to create is one of peace, appreciation, fun, action and accepting. We are a gift community, whereby if someone is in need, their needs are met. Exchange occurs on many levels, each being a gift of love from one to another. As a group, we work together to realise our dreams and the dreams of our creator for our earth and us. When we work, people offer their skills, talents and interests to further the creation of the community. These gifts are offered in many ways, including the teaching of life skills, wisdom of the elders, innovations and inventions, practical projects, artistic expressions, story telling and celebrations. Owning our truths, our communication and our commitment lead us to a living space of effectiveness and efficiency. A peace forum to resolve conflict, lead by our wisest is offered to those who wish it.

Ecology
Living in harmony with our earth brings a way of being which is sacred and healthy. Nourishing and supporting her requires gift energy too. To nourish the soils, keep water ways clean, encourage the presence of wildlife, waste minimally, enhancing the forest, requires us to live in certain ways. Our homes will be built from the earth or recycled items, our energy will be created by us, our water systems will be recycled, our foods whole and organic and grown by us, and pool cars will provide us with transport in and out of town.

Aesthetics
Being a community of young to elder, of diverse talents and interests, of various spiritual paths, our village will be reflective of all we give and want. We will build a village of cluster homes according to the dictation of the land. We will create the facilities to meet our dreams. To date these include a community centre with a kitchen and stage for our entertainment and visitors, a school for our children, information technology services for communications and sacred spaces for our ceremonies. The arts hold great value for many of us; live theatre, live music, dancing, slow food, costumes, sewing, writing, gardening, painting and decorating, are some of the ways which we'll share ourselves and have fun. 5. Constitution of Non-Profit Community Association
(Etherion Eco Village Community Association)
(Summary of previous listings, see links this page):

· This association of members exists to facilitate the provision of a harmonious residential village / hamlet style settlement at the property Etherion.

· The principles of the lifestyle associated with, and embodied in, this settlement will be based on:
Ecologically sustainable use of the land, and proper management of the resources within the property.

· A supportive structure and co-operative exchange of resources and labor.

· Respect for the right of all Members to live in peace within the Etherion society.

· A fair and equitable system of levies and maintenance charges within each sub-group (hamlet), and generally within the whole of the cluster of hamlets, the eco-village.

· An economically viable system of barter and counter-trade ...similar to the LETS groups and inter-changeable with Aust. currency.

· An open, honest and accountable system of governance based on the principles of sociocracy.

· An awareness of, and respect for, the rules within the Etherion society; with particular emphasis on the provisions within these rules to expel any Member who is judged, by the community, to have transgressed basic rules. A process, having several stages, will be commenced leading up to this final decision and through it every option for re-integration of this Member will be made.

· A committee of eleven members will be elected to fill positions (noted elsewhere in policy & guidelines) each year. The committee will be charged with the following duties:
1. Notify members of Annual General Meeting (AGM).
2. Convene Special General Meeting (SGM) to discuss or vote & address items of policy, deal with issues affecting members (eg interaction with Council or other land holders or enforcement of rules etc).
3. Keep accounts & trade with suppliers & customers.
4. Monitor environmental & general living conditions within the Village.

The principles embodied in the Ringing Cedars Series Books (Vladimir Megre) and other references such as Conversations with God (Neil Donald Walsh) will be used as guidelines in the decisions the community will make.

6. Membership Levels

Overview of Subject: This community seeks to attract members from all socio-economic groups; and levels of residency may reflect a person's economic choice / status but will not differentiate their status within the Etherion Community.

Four main types of residency will be offered at Etherion.

1. Full Member: Right of Use contract for residency on Allotment / Domain; (min. one hectare) cost is $20G (payable over 1-3 yrs.) plus annual maintenance / levy costs.

2. Full Member: Shared (Right of) Use of Allotment / Domain with 1-4 other (max. 5) Members; [min. one hectare], cost is % share each of $20G (payable over 1 - 3 yrs.) plus % share of annual maintenance / levy costs, (note; certain requirements are applicable for Members wishing to take this, limited, option including a minimum of three (3) years as an Interim Member, and a mediated process of choosing shared users)

3. Secure Contracted Residency: Interim / Probationary / or / Full Member in a Community Housing Unit (CHU): of various sizes [approx 6.5 sqs, one B/R, (60 m2), up to 11 sqs, three B/R, (100 m2)] including exclusive use of a designated section of a Community Garden Plot, (CGP) and a designated supply of firewood provided each month.

Costs are based on the period of tenure chosen, with a minimum period being one (1) year and a minimum period of three (3) months being required as notification of vacating the CHU.

It is hoped that monthly costs will range from approx. $390.00 up to $890.00 inclusive of annual maintenance / levy charges. Other factors determine monthly living costs, including the standards a CHU is equipped at, [eg: bottled L P Gas supplied for heating / cooking, 12 V solar for lighting only / or / 240 V power option for occasional / moderate usage in each 24 hr. period, collected rubbish removal, etc]

4. Casual Residency Interim (probationary) / or / Full Member / or / Guest / Visitor in a CHU / or shared use of a CHU / or / shared 'dormitory style' use of a 'long house style' CHU

Usually this will apply for overnight / weekend accommodation.

Costs are approx. $8.00 - $30.00 per night (pre-payment required) and vary depending on the level of accommodation, Camping on a powered site (or un-powered) is available and costs start at $4:00 per person, per night (discounts apply).

Members / Guests and Visitors involved in Community Project work will be offered discounts of up to 100% from these charges, however may be required to pay food costs.

7. Etherion Eco-Village Membership Application Details

If membership is approved the balance of $450 is payable to activate membership. Membership begins on the first day of the month following application and extends for one calendar year. Subsequent annual membership costs ($150 per annum) will be included in a levy charged to all Members in residence at Etherion, or notified one month before falling due to non-resident Members.

9. Commitment Declaration:

* I commit to live in harmony with Nature, myself and others in this Community.
* I will LOVE AND RESPECT Nature, Myself and Other Members of the Community, therefore I accept that alcohol abuse, non prescription drugs use and domestic or other type of violence are not part of this Eco-Village.
* I will build according to the following principles of Permaculture:

1. To read the patterns of the landscape and turn any problem into a resource.
2. All elements of the building will harmonize with Nature, becoming part of it.
3. Buildings will be solar passive heated and properly insulated to reduce the need for expensive and resource consuming demands of high technology.
4. The buildings will be self sufficient in electricity, water and sewer systems.
5. The planting will be according to permaculture zones and it will use water conservation and flood controls for harvesting run-off water.

* I accept that there is a probationary period of membership (minimum 1 year) during which time my decision to build in this Eco-Village will include a commitment to remove such capital improvements as I may make if I chose to leave the community. (If a police check shows issues that need resolving this probationary period could extent to 3 years).

10. Members Investment Scheme:

A scheme will be available for all Interim Members who elect to take up an offer to provide extra investment over and above the standard 'buy-in' price. However, if an Interim Member (read Probationary if you choose that description better) chooses to leave the Community before attaining Full Membership the Community (the EEVC Assoc.) will redeem (buy back) this one (1) Unit Trust Share (UTS) certificate at its purchased cost ($2G).

As a return on this investment a discounted rate will apply for annual levies charged until they reach full membership status. For further details of this offer contact the committee.

To qualify they will be required to pay an additional amount of $2G with the first payment for their use of the Allotment / Domain that is issued to them. This first payment, covering one (1) year of use (residency) is also $2G, so the overall upfront cost is $4,550.00 (includes membership application cost of $550.00).

Thereafter they will be required to make annual payments of $3G [second year], and $5G [third year], and when up-grading to Full Membership pay the balance of $8G. Payment of the additional $2G will allow the Interim Member to receive a UTS certificate, to be held as part of the ten (10) required for Full Membership at the time the Member upgrades to Full Membership they will receive an additional nine (9) UTS certificates.

All subsequent prospective members will be required to pay $20G for Full Membership under the same three-year phased probationary period.

However, there may be offers made to selected prospective members to receive a financial discount at the time they apply for Interim Membership. This offer would be made only after a Common General Meeting (or Special general Meeting) had approved such an offer. Several parameters would be used to determine the eligibility of a Prospective Member, and a meeting of the comity would decide on the available material presented to that meeting.
Every prospective member would have the opportunity to make an application for consideration of a similar offer, there would be no precedent set by a particular offer made to a selected member.

11. Codes of Conduct / Spiritual Guidelines
(Summary of previous listings, see links this page):

Overview of Subject: Each Member agrees (at the stage of applying for Interim Membership status) to abide by the Rules of the Association.

All Members acknowledge the provisions within these Rules that allow for the other members (either singularly or jointly) to raise issues of conduct before a Policy & Guidelines Sub-Committee.

This group will comprise a minimum of three Members (and a maximum of seven) and will have the power to convene a Special General Meeting of Members where an issue is considered to warrant this.

Any Special General Meeting of Members [and / or Annual / Common General Meeting (conditions apply)] will have the power to expel from the Association a Member deemed to have transgressed the Policies, and / or Guidelines of the Association, where there is no ability to resolve such transgression to the satisfaction of the Meeting of Members.

Guidelines for Intentional Community Group as written October 2007

1. Be able to admit we know very little so we can aspire to make the unknown known.
Those who "know it all" place themselves & others in the greatest peril.
Knowledge is just data. It needs to be applied to gain wisdom.
Divinely inspired material increases our knowledge data base such as the 8 limbs of Yoga (not just exercise) or modern data such as Conversations with God (CwG) material.
Balance intellect with intuition. Both study & meditate, physically & mentally.

2. Eradicate self-importance. Stop wasting our precious energy feeling offended by the deeds & misdeeds of our fellow men.
The outside world is merely a reflection of our inner self. Blame therefore outside ourselves is merely self-criticism, be grateful for indiscretions & take responsibility when things go wrong, know you have attracted the conditions.
Allow others their own opinions, even if opposed to our own. Listen intently to another without judgement & admit that you disagree if necessary without annoyance nor anger.

3. Admit that this is not real, it's an illusion, a game we play that allows us to evolve. It gets damned real when we forget this & get lost in the illusion.

4. Daily practice, guided or not, physical, mental & energetic.
Take responsibility for your physical, mental & emotional self so that you are a useful member of the Community.
Classes will be offered freely, just as everyone will have offerings to share.
Heed the advice of not-doing, not expecting reward for contribution & service.
Act just for the hell of it.
If it seems you're getting a raw deal, certainly raise this in the Community Circle.

5. Compulsory attendance weekly in a Community Circle.
What's the point of a Community if we do not commune?
Do not dominate the group, rather encourage everyone to contribute equally if possible.
Consider that EVERYONE in the group has pearls of wisdom to share.
Emphasize the highest attributes of everyone, regardless of your personal opinions of individuals.
If there are rules, respect them, do not step over boundaries.
Be punctual. Anarchy is fine with everyone doing what pleases them, but is defined as Lawless Confusion.
One person at a time to speak, do not interrupt till they are finished.
By the same token, stay relevant to the topic & avoid stories, stick to personal experience.
Starting satellite conversations is disrespectful to the one speaking, avoid this.

6. Rules & compulsory admonitions are only necessary in a primitive society. Admit that perhaps we are not quite "highly evolved" & therefore subject to regulation although we can strive to minimise this.
"Do not do what you want, then you may do what you like." - Yogananda

7. The only way to avoid obsessive behaviour is to laugh, particulary at oneself. Have a sense of humour & spirit, be En-Light-ened. Self pity, physical, mental or environmentally induced, is obsessive behaviour reeking of self-importance. Accept the challenge of your circumstances & find ways to ride above these conditions merely by changing focus. On the other hand, have compassion for those struggling to rise above their condition (without feeling sorry for anyone!).

8. The Group Motivation is one of Love & Joy, NOT Fear. We are NOT inviting a life-&-death struggle, but a provisional retreat from a monster rearing its ugly head before it dies.

12. Interim Policy and Guideline Notes
(Summary of previous listings, see links this page):

Overview of Subject: These policies are very incomplete. They are included here to stimulate discussion between incoming Members and begin platforms of discussion about the various topics that will affect membership as it increases

As an example, the discussion to allow slaughter of animals for food production on the property is largely unresolved because a large percentage of potential members follow meat free diets and have strong principles and views about factory farming of animals. Topic 16: Guests of Members / Terms of Accommodation:

1. Guests must be signed in by a Member, who then becomes responsible for any outstanding guest accommodation fees (sign in process includes form requiring medical contact details; next of kin contact details; agreement to abide by rules of association, insurance cover details: some exceptions apply- see notes below re: shorts stay workshops guests; working guests).

2. Short stay guests (< 1 month) pay $8:00 per night up to a maximum of $50:00 per 7-day week.

3. Extended stays (> 1 month) are to be processed through a Duty Admin Officer [DAO] and require a 7-day approval window to allow any objections from other Members.
Rates for extended stays are as per short stay, but paid 4 weeks in advance.

4. Accommodation must be at Members dwelling (private allotment or Community Housing Unit [CHU]). Note that this dwelling must be rated to allow for extra use of fixtures by guests, (eg: sanitary / grey water usage).

5. Note 1: Workshop / Work Stay Guests
a. These guests can be signed in under the authority of the Committee (of EEVCA) via 2 Duty Roster Admin Officers (1 is always on call 24-7) after payment in advance is received for duration of stay. Accommodation can be either dormitory style CHU, Motel Style Single (or family CHU), or with Members in their own dwellings

b. In cases were work input is traded for accommodation fees via involvement in a community work project (CWP; eg: CWP#15/26.0709-weeding removal and fencing of community garden plot No. 4), the fee payable may reduce to zero and the format used in WWOOF trading.

6. Note 2: Disputes Between Members & their Guests
a. If a dispute exists the member must notify the committee (via the DAO within 24 hours), and their guest will be required to leave after a further 24-hour period of grace. After this period they will be termed as trespassers.

Any such dispute will involve the offer of mediation / counselling by one (or more) Member(s) of the EEVCA Committee to the affected Member and guest. In cases of hardship arrangements may be possible to provide limited continuing accommodation.

Topic 17: Government Road Use / Terms of Restrictive Covenant Applying to EEVCA:

1. An agreement in principle exists between local council officers and the owners of the land at Etherion for a maximum of 20 vehicle trips per day to use the access class gravel council road that leads from our front gate (one way usage constitutes one trip).

2. Thus vehicle usage by Members needs to be co-ordinated and we recommend that a schedule (posted daily) will show proposed vehicle trips by Members and their guests. To maximise road use efficiency we envisage that several tasks shall be achieved with each trip (eg: school runs, for students at primary / secondary schools, can be co-ordinated with pick up of supplies / collection of passengers from bus / train / plane terminals etc).

3. Within the property vehicles generally will be permitted to be used throughout most common use areas (exceptions apply see point 4). A speed restriction of 40 km / hr will be enforced (in practical terms 15 - 20 km / hr will be usual since road access is mostly at "bush track" status, suitable in dry weather for 2-wheel drive vehicles, but only 4-wheel drive in some cases).

4. Certain areas within the property are allocated to be "vehicle free" (with exceptions for delivery of items requiring a vehicle [eg: building materials], but only within restricted hours [eg: 12:00 midday to 4:00 pm]). Outside of these times agreement must be obtained from affected hamlet residents.

5. Designated areas, all accessible by 2-wheel drive vehicles (near the front gate and at other locations) are available for parking of Members and guests vehicles. These areas double as assembly points for emergency evacuation and incident control centres (eg: bush fire / medical / air ambulance etc.).

6. There will be registered vehicles for specific usage made available to Members (eg: 7- seat 4WD; 2WD station wagons) and other non-registered vehicles (eg: 4WD crane-truck with trailer for wood / building material collection; tractor with grader blade). A fee for usage, to cover maintenance and operating costs, will be charged using a sliding scale depending on frequency of use. Bookings and payments are to be made through the DOA with a minimum 24 hours booking window required (exceptions apply).

Topic 19: Business Structures within Etherion

Overview of Subject: Power generation (to a large extent most areas will only have low amperage solar based electricity) will determine siting and choice of available industries. Self-sufficiency of power and water will thus be major factors to be considered. Transport of finished products to point of sale locations (POS) will limit choices. Some examples of business types follow, however the list is incomplete.

· Yoga retreats
· Bush walking and camping
· Horse riding
· Organic food production sales
· Mountain Bike Adventure tours
· Website design and creation
· Orienteering
· Cottage industries
· Internet sales

1. Certain business will be deemed as unsuitable, including toxic waste dumps (!) ("All those professions that bring hurt to the earth, to the great work of the creator", Ringing Cedars book 3 pp: 193). It is hoped that all members will fervently consider the environmental and social implications of any business that they propose to bring into the community.

2. Strict adherence to environmental safety concerns will be fully expected from all Members.

Topic 20: Stages of the Expulsion of a Member include:

1. Documentation from all affected, and interested parties (groups, individuals) as to the allegations made, the sections within the Policy & Guidelines alleged to have been 'broken', suggestions for the fairest and most 'just' system of resolution of the 'alleged' action(s).

2. An advertised / transmitted plan for this resolution setting an agreed time-frame and setting any 'restrictions' / binding agreements / prohibited actions / etc, that may be deemed necessary. (eg: in the instance of an alleged assault that may have involved a Member misusing their position within a Committee role, that Member would be expected to step down from the role and allow a temporary replacement for the duration of the inquiry)

13. Future Sale of Free-Hold Title to Etherion

Overview of Subject: Tenure of right of use of land will be assured for members during any sale of the land. Terms of Right of Use of an allotment include a 3x25 year agreement and this will be transferred to any new owners. EEVCA is to receive first right of refusal to purchase the property.

Any future sale of the freehold title to this land includes in the sale a commitment to comply with the terms of a restrictive covenant put in place to protect the interests of the Members of the EEVC Assoc.

This deed specifies the nature of the restrictions placed over the land title, including an obligation to continue to uphold a committment to current members who are in residence at Etherion.

Similarly this deed sets out the possible future uses of the common land areas, and the relationship between these areas and the domain plots that are spread throughout the property.

All Members who are exercising their right to live on the domain / plot that has been allocated to them will continue to hold this right, and the same contract for use of the common land areas held by the Association (for the members of this Association) will continue to be uopheld by any new owner of the free hold title.
